Upon receipt of a valid DMCA Notice, BizzTycoons will take the following actions:

  1. BizzTycoons will review the DMCA Notice to ensure that it meets the requirements specified by the DMCA.
  2. If the DMCA Notice is complete and valid, BizzTycoons will promptly remove or disable access to the allegedly infringing material.
  3. BizzTycoons will notify the user who posted the allegedly infringing material and provide them with a copy of the DMCA Notice.

Counter-Notification:

If you believe that the material removed or disabled by BizzTycoons is not infringing, or if you have the necessary rights to post such material, you may submit a counter-notification (“Counter-Notice”) to the designated Copyright Agent. The Counter-Notice must include the following information:

  1. Identify the specific material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  2. Provide your contact information, including your name, address, telephone number, and email address.
  3. Include a statement that you consent to the jurisdiction of the federal district court in which your address is located, or if your address is outside the United States, to the jurisdiction of any federal district court in which BizzTycoons may be found, and that you will accept service of process from the person who provided the DMCA Notice or an agent of such person.
  4. Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  5. Include your physical or electronic signature.

Upon receipt of a valid Counter-Notice, BizzTycoons will take the following actions:

  1. BizzTycoons will review the Counter-Notice to ensure that it meets the requirements specified by the DMCA.
  1. If the Counter-Notice is complete and valid, BizzTycoons will promptly provide a copy of the Counter-Notice to the original complainant.
  2. BizzTycoons will restore the removed or disabled material within 10 to 14 business days following receipt of the Counter-Notice unless the original complainant provides notice to BizzTycoons that they have filed a legal action seeking a court order to restrain the alleged infringer from engaging in the infringing activity.

Repeat Infringers:

BizzTycoons reserves the right to terminate, in appropriate circumstances, the accounts or access of users who are determined to be repeated infringers. BizzTycoons may also, at its discretion, limit access to the Website and take other appropriate actions against repeat infringers.
